1. Business & Brand Information

Phenomenail® is a professional nail industry brand founded and owned by Lauren Kasper-Harris, previously known as Lauren Mitchell.

The Phenomenail® registered trademark, brand identity, original creative works, copyright and associated intellectual property and goodwill are the personal property of Lauren Kasper-Harris, to the extent legally vested in her.

Phenomenail Ltd is authorised by Lauren Kasper-Harris to use the Phenomenail® brand, trademarks and associated intellectual property for its business operations.

This authorisation does not constitute a transfer, assignment or surrender of ownership.

All original creative works and intellectual property owned by Lauren Kasper-Harris and published through Phenomenail® are protected under applicable UK and international intellectual property laws.

This includes, but is not limited to:

  • All original nail photography, product photography, promotional images and visual content

  • Website images, graphics, layouts and original written content

  • Logos, brand artwork, packaging designs, labels and original visual identities

  • Product photography, advertising materials and promotional campaigns

  • Original product descriptions, marketing materials and written publications

  • Educational courses, manuals, tutorials, training documents and teaching resources

  • Videos, demonstrations, recordings and social media content

  • Original illustrations, designs, digital artwork and other creative materials

  • Original product and collection names, where legally protected

  • AI-assisted creative works and their protectable elements, to the extent recognised by applicable law

All copyright and associated intellectual property rights belonging to Lauren Kasper-Harris remain her personal property unless expressly transferred by a valid written agreement.

Phenomenail Ltd is permitted to use these materials for authorised commercial purposes but does not acquire ownership of them through that use.

No licence or permission is granted to any third party except where expressly authorised or permitted by law.

3. Trademarks & Brand Protection

Phenomenail® is a registered trademark personally owned by Lauren Kasper-Harris.

The Phenomenail™ M.E.T.A Pro Gel System, including BOND-R, UNIGEL-X, STRUCT-R, PIGM-A and FIN-X, forms part of the Phenomenail brand identity and associated intellectual property portfolio.

All rights in the registered trademark, associated brand names, logos, distinctive product identities, original packaging artwork and other legally protected brand elements are reserved to their lawful owner.

The use of the ™ symbol identifies a claimed trademark and does not necessarily indicate registration.

No person or organisation may use protected Phenomenail® branding in a manner that infringes applicable intellectual property rights, misleads consumers or falsely implies affiliation, endorsement or authorisation.

4. Founder Identity, Historical Rights & Goodwill

Lauren Kasper-Harris was previously known professionally as Lauren Mitchell.

Both names identify the same individual, founder and owner of the Phenomenail® registered trademark.

All intellectual property rights, copyright and goodwill lawfully established, acquired or held by Lauren Mitchell remain vested in Lauren Kasper-Harris following her change of name.

This includes relevant rights associated with historical photography, educational materials, professional achievements, publications, awards, collaborations, original creative works and brand development.

The change of name does not constitute abandonment, relinquishment, assignment or transfer of any intellectual property rights.

Lauren Kasper-Harris expressly reserves all existing rights and goodwill belonging to her, whether established under her current or former name.

5. Authorised Use by Phenomenail Ltd

Phenomenail Ltd operates under permission granted by Lauren Kasper-Harris to use the Phenomenail® registered trademark and associated intellectual property owned by her.

Such permission is granted for authorised business activities, including the promotion, marketing, distribution and sale of Phenomenail® products and the Phenomenail™ M.E.T.A Pro Gel System.

The company does not acquire ownership of Lauren Kasper-Harris's intellectual property merely through its authorised use.

Ownership, licensing and any goodwill arising from use of the brand remain subject to the rights of the lawful owner and any applicable licensing arrangements.

No third party may claim to be an official distributor, educator, representative, partner or licensee without appropriate authorisation.

6. Restrictions on Reproduction & Use

Unless expressly authorised in writing by Lauren Kasper-Harris or otherwise permitted by law, no person or organisation may infringe protected Phenomenail® intellectual property by:

  • Copying, reproducing or redistributing original photography or product imagery

  • Using protected images, artwork or branding in unauthorised commercial advertising

  • Reproducing protected product packaging, labels, graphics or brand designs

  • Republishing, selling or distributing protected educational content

  • Copying original website content for unauthorised commercial use

  • Removing or altering copyright notices or ownership information unlawfully

  • Falsely claiming authorship or ownership of original creative works

  • Using protected trademarks or branding to create confusion about commercial origin or affiliation

  • Exploiting protected content for commercial purposes without the necessary permission

The publication of images, videos or other content on this website or associated social media platforms does not place those materials in the public domain.

Downloading or accessing content does not transfer copyright or grant commercial usage rights.

All applicable copyright exceptions and other legally permitted uses remain unaffected.

7. Educational Content & Digital Materials

Original Phenomenail® educational materials, including tutorials, training manuals, course content, demonstrations and downloadable resources, are protected by copyright where applicable.

Purchasing or accessing educational content grants only the usage rights expressly provided with that purchase or access.

Unless authorised, protected educational materials must not be reproduced, redistributed, resold, republished or presented as independently authored content.

All underlying intellectual property rights remain with their lawful owner.

8. Photography, Digital Artwork & AI-Assisted Content

Original Phenomenail® photography, promotional imagery, artwork, videos and other creative materials are protected to the extent provided by applicable intellectual property law.

Where digital or AI-assisted production methods are used, all enforceable rights in eligible original works, human creative contributions, branding and other protected elements are reserved.

No claim is made to exclusive copyright ownership of material that is not legally eligible for such protection.

Unauthorised commercial exploitation of protected content may result in enforcement action.

9. Ambassador, Brand Representative & Collaborative Content

All content created specifically for the Phenomenail® brand by appointed ambassadors, brand representatives and contracted content creators is subject to the intellectual property and usage provisions of their respective agreements.

Under the terms of the Phenomenail® Ambassador Agreement, Lauren Kasper-Harris holds exclusive, worldwide, perpetual and unrestricted commercial usage rights to content created for the Phenomenail® brand, as granted under the applicable agreement.

These rights include the use, reproduction, publication, editing, adaptation, distribution, display and commercial exploitation of content across all current and future marketing, advertising, promotional and digital platforms.

No third party, business, brand or individual, other than the original ambassador or creator exercising their retained rights, may reproduce, distribute, publish, modify or commercially use such content without the prior express written permission of Lauren Kasper-Harris, except where otherwise permitted by law.

This restriction includes unauthorised use of ambassador-created content for competing brands, product advertising, commercial promotions, websites, social media campaigns or other business purposes.

The original ambassador or creator retains the right to use their own content in accordance with their agreement, including any applicable contractual restrictions.

Lauren Kasper-Harris may authorise Phenomenail Ltd to use ambassador-created content for the brand's commercial and promotional activities.

The rights granted to Lauren Kasper-Harris remain in effect indefinitely, including after the ambassador's appointment or contractual relationship ends, unless otherwise provided in the applicable agreement.

All rights are reserved and subject to the terms of the relevant agreements and applicable law.

10. Intellectual Property Enforcement

Lauren Kasper-Harris reserves the right to protect and enforce her intellectual property rights.

Where infringement is identified, appropriate action may include:

  • Formal requests for removal of infringing content

  • Copyright or trademark infringement reports to relevant platforms

  • Requests to cease unauthorised commercial use

  • Legal proceedings or other remedies available under applicable law

Failure to take immediate action against a particular infringement does not automatically constitute a waiver of existing rights.

11. Website Information & Liability

Phenomenail® makes reasonable efforts to ensure information published on its website is accurate and up to date.

Product descriptions, availability, specifications and other information may be updated where necessary.

Nothing in this Legal Notice excludes or restricts statutory consumer rights, liability for fraud, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded.

12. Governing Law

This Legal Notice is governed by the laws of England and Wales, subject to any mandatory legal protections that apply.

All intellectual property rights remain enforceable in accordance with the applicable laws and jurisdictions in which those rights exist.
